At the hearing, President Gensler did not give a clear answer to the question whether or not the ETH was a commodity, maintaining the consistent ambiguity of the SEC on the issue. With regard to differences in regulatory capacity, Gensler criticized the industry’s & ldquo; contempt for ” and noted that unlike the CFTC, the SEC was responsible for overseeing disclosure of information, so CFC was not currently fully equipped to regulate disclosure-based regulatory systems. He mentioned that, if Congress legislation did give CFTC more responsibility for regulating encrypted currency transactions, CFC still did not have some of the necessary powers to regulate the encrypted currency market. He stressed that CFTC lacked traditional regulatory tools that would strengthen the United States capital and derivative markets, such as registration, trusteeship, surveillance and supervision, and expressed the need for CFTC to strengthen those capacities with a larger budget.

Their agencies had recently taken action to block such contracts, and President Benham had made it clear that they were taking steps to ensure that such contracts were prohibited because “ the last thing we need now was commercializing the election & & rdquao; and stressed that such conduct & & ldquao; and that there was a clear violation of existing laws & & rdquao;
